WINDSOR - A 26-year-old babysitter who seriously burned a three-year-girl she was potty training was sentenced today to one year of house arrest plus two years probation.
"The facts of this case are particularly tragic," said Ontario Court Justice Micheline Rawlins in handing down the sentence.
"This child has had a most difficult life."
Kelly Rainone, who pleaded guilty to burning the toddler last February, was ordered not to leave her home except for medical or religious appointments.
Court heard Rainone originally said the child was burned with spilled soup. But Rainone later admitted she became angry because the girl wasn't toilet trained, so she put her in the shower and turned on the hot water.
The toddler suffered second- and third-degree burns on her head and upper torso.
"Your honour, she feels terrible for what happened," said defence lawyer Tom Liddle. "This is something that (the burned girl) will have to live with, but my client, having caused it, will also have to live with."
Assistant Crown attorney Randy Semeniuk, who asked for six to nine months of incarceration, called the incident serious.
"This was a defenceless child who was entrusted into the care of the accused," Semeniuk told the court.
Rainone cannot possess or consume alcohol or controlled substances during her sentence.
Furthermore, for the next three years Rainone may not communicate or associate with Glen Brantley, a former boyfriend who was living with her at the time of the incident.
