Appeal from the general meeting of heads and representatives of
Constitutional local communities of Ukraine
Considering the constant unconfirmed (!) statements of the Ukrainian officials on Ukraine-EU rapprochement, the fact of falsification the text of the European Charter of Local Self-Government is causing resentment, and has not received an adequate response from the Ukrainian government for decades. In particular, the European Charter of Local Self-Government as a document which regulates the livelihoods of local authorities (local communities) is transformed by falsified translation (including term «local authority») as the regulator of local government activities, namely local administrations. By inadequate translation the community is deprived from the effective instrument of using the Charter of the community (by the translation, the term is generally removed from the European Charter).
It is important to remind that under current legislation the Parliament ratified the original of the European Charter (which is available in English and French) but not the appointed falsified translation.
In this situation, there is no any connection between the community and its bordies. Moreover, the right of the general meeting has exclusively status of advisory solutions.
Despite the attempts of communities transformation to the exclusively territory of residence, but not communities of residents with power (that is provided by amendments to the Constitution according to the Presidents’ draft) this practice is fully not consistent both Ukrainian national traditions and standards of all models of local self government without exception.
We kindly ask your support in eliminating such flagrant violations of the rights of communities and also human rights, to which in accordance to the Declaration on Human Rights is guaranteed the opportunity of regularly participation in state and municipal management.
