Могли бы, конечно, и по-больше сумму назначить, а то, такая сумма для СМ копейки, но и то хлеб. И то, что суд признает, что таковые вмешательства всё же были (это не выдумка фанатов), тоже плюс в нашу копилку. Правда вот меня немножко смущает тот факт, что суд ожидает новые вмешательства СМ, именно по этой причине они и назначили эти санкции :( ...
After the Seoul Central District Court dismissed both of SM Entertainment’s injunctions against JYJ last week, the judge Kim Daewong has decided to incur a fee against SM Entertainment every time they interfere with JYJ’s activities. Through a press release, JYJ’s current acting agency said on February 21st, “SM Entertainment will not be allowed to interfere with JYJ activities and will pay 20 million won every time they violate this court order.”
The court has decided that there is a possibility that SM Entertainment will interfere with JYJ’s activities, and in the case that they do interfere, have made this ruling. To prevent any possibilities of interference, the court has ordered a restraining order against SM Entertainment.
Even though the court has ruled in favor of JYJ, C-JeS Entertainment’s Baek Changjoo said, “There are still many obstacles to go over. There are many things still to be worked out even with the court ruling in our favor. I hope the public and fans support our cause and help create a more progressive celebrity system.”

The Court has decided that should SM Entertainment choose to hinder in any of JYJ’s activities, they are required to pay a fine of USD17,800 or 20,000,000 WON for each interference.
Seoul’s JungAng District Court (Civil Affairs Counsel number 51 Chief of Jurisdiction Kim Dae Woong) said through an indirect coercion injunction , “It is wrong for SM to hinder the activities of JYJ, and if there is a violation, SM will be required to pay a fine of USD17,800 for each violation.”
The Court, “Even though there has been a provisional disposition that the effectiveness of the exclusive contract has been on suspension on 27 Oct 2009, SM, on 2 Nov 2009, opened a press interview stating that there’s a requirement to follow the exclusive contract and on 2 Oct 2010, SM sent Warner Music Korea the contents of proof and requested that they stop the production and distribution of JYJ’s Worldwide album. Looking into it, there is a probability that it has hindered JYJ’s activities and thus the decision of an indirect coercion injunction.

The courts ruled that SM Entertainment would have to pay JYJ 20 million KRW every time they interfere with JYJ’s activities.
Seoul Central District Court (Civil Department 51, Judge Kim Dae Woong) ruled, “SM cannot interfere with JYJ’s activities. SME will be forced to pay 20 million KRW each time they fail to comply with the courts’ ruling.”
In response, during a phone interview with TV Daily, a JYJ representative stated, “I don’t think the courts ruling will directly result in JYJ’s appearances on broadcasts. However, I hope someone will listen to the courts’ decision to side with JYJ.”
Furthermore, he said, “I hope the public and broadcasters will continue to pay attention in this current situation and help us develop a more fair and better system within the show business. I hope the courts’ decision will become a hope for JYJ’s future activities.”
Meanwhile, the courts ruled on February 17th against all injunctions filed by SME against the suspension of JYJ’s contract and ordered SM to stop interfering with JYJ’s independent activities.
